1. These are the contest rules ("Rules") and apply to Record-Play Artist Development Programme organised by Record-Play ltd. By entering this Competition, entrants (“Entrants”) agree to be bound by these Rules.

2. In consideration of Record-Play ltd agreeing to assess entries to the Events each Entrant by entering licenses Record-Play ltd for itself and those authorised by it the right to use an entry for communication to the public (which includes broadcasting and internet use) and all other rights for the purposes of the Competition only. This licence shall subsist until the Entrant is unsuccessful, or in the case of successful entries until the end of the Competition (30/0909) or until the Entrant is notified that they have been unsuccessful if sooner or if later until the conclusion of any good faith continuing discussions with Record-Play ltd concerning future use of the entry.

3. Entrants agree to grant Record-Play ltd a non-exclusive licence to broadcast their entry across any online platforms. This licence does not affect Entrants moral rights and Entrants will retain full rights in their recording and composition insofar as they are the original author.

4. All submissions must be completely original; no samples or work of other artists can be used. The Competition organisers accept no liability if Entrants ignore this rule and Entrants agree to indemnify fully Record-Play ltd against any claims by any third party arising from any breach of this or any other rule.

5. The Entrant(s) must be the sole author(s) of the entry (except where more specifically provided).

6. Additional evidence may be required in order to verify an Entrant’s identity. This may include a valid passport or driving licence. By entering the Competition, Entrants hereby warrant that all information submitted by them is true, current and complete.

7. By using the site and/or entering the Competition, Entrants warrant that they have legal capacity to enter the Competition and agree to be bound by the Rules (i.e. that they are of sufficient age and mental capacity and intend to be bound by these Rules).

8. Record-Play ltd reserves the right to refuse any entry for any reason at its absolute discretion and to disqualify any Entrant if it has reasonable grounds to believe the Entrant has breached any of these terms and conditions.

9.In the event that any Entrant is disqualified from the Competition, Record-Play ltd may decide whether a replacement contestant should be selected. In this event, further Entrants will be selected on the same criteria as the original Entrant and will be subject to these Rules. Record-Play ltd reserves the right to vary the terms of the competition or cancel it if it deems it necessary to do so or if circumstances arise outside its control.

10. Only one entry per person or group is allowed. Competition entries must be made in the manner and by the closing date specified on the Competition Notice. Failure to do so will disqualify the entry.

11. It is a requirement of this Competition that Entrants must be 18 years or over by 30th September 2008.

12. Entries are made at an Entrant’s own expense and risk and Record-Play ltd shall not be liable to reimburse any expenses incurred in making an entry.

13. Entry to the Competition will only be accepted by postal entry. Entrants should note that Record-Play ltd does not accept responsibility for, and cannot return any Competition entries, including those consisting of artistic or other material. It is therefore advisable for each Entrant to retain a copy where appropriate. Proof of posting or uploading cannot be accepted as proof of delivery.

14. Attendance by Entrants at any event staged by Record-Play ltd (including but not limited to master classes and mentor sessions, attendance at which may be won as a prize) (“Event(s)”) and travel to and from any such Event is also at the Entrant’s own risk and Record-Play ltd accepts no responsibility or liability in this regard. The competition winner will be provided funds (as outlined in the prize), to be paid into the competition winners account no more than one week after the winner has been notified.

15. All Entrants must (except where otherwise provided) be resident in the United Kingdom. For those Events which offer successful candidates freelance work or employment contracts Entrants must be eligible to work in the United Kingdom.

16. The decisions of the judges are final. Neither correspondence nor discussion concerning any decision shall be entered into. Unless specifically stated unsuccessful Entrants in any stage may not be contacted by Record-Play ltd due to the large number of entries anticipated. Record-Play ltd shall not be obliged to make use of any entry and shall not be liable for any loss of publicity or enhancement of reputation.

17. Successful Entrants will be notified in the manner and within the time specified on the Competition website. Return of any prize notification as undeliverable or failure to reply as specified in the notification within the time stated therein may result in disqualification and selection of an alternate winner.

18. Record-Play ltd cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any Entrant entering the Competition or as a result of accepting any prize.

19. Successful Entrants may be requested to take part in promotional activities. Record-Play ltd reserves the right to use the names of winning Entrants, their photographs and audio and/or visual recordings of them in any publicity.

20. Any personal data relating to Entrants will be used solely in accordance with current UK data protection legislation by the Competition partners and will not be disclosed to a third party without the individual’s prior consent.

21. The description of the awards prizes and selection process in the Competition literature or other medium is not binding and may be varied by Record-Play ltd and Record-Play ltd may make additional awards or prizes but it shall not be obliged to make any award or prize if it considers it inappropriate to do so. Awards and Prizes are non-transferable.

22. Acceptance of these rules is a condition of entry and receipt of an entry by Record-Play ltd amounts to acceptance of the rules.
